How smoking or allowing weed use at home can get you evicted

27th June 2019

It’s common knowledge that cannabis is an illegal drug in Britain – but what if you’re using it behind closed doors? The risks could be even higher.

Landlords do not tolerate antisocial behaviour. it’s in the small print of every tenancy agreement and if you’re caught smoking illegal drugs (or allowing others to do so) at your home you can find yourself in serious trouble – including gaining a criminal record and even eviction.

Yes, you can be handed an eviction order – even if cannabis is consumed behind closed doors by you or your family and friends.

In Merseyside, a network of housing providers have previously teamed up with authorities and fire services to launch a ‘USE IT? LOSE IT!’ campaign warning tenants that they could be on the verge of losing their home if caught using the substance in their property.
Registered housing providers including Riverside, Liverpool Mutual Homes (LMH), Plus Dane, Adactus, Cobalt, One Vision, Pier Head, Contour, Your Housing and South Liverpool Homes (SLH) are working alongside Liverpool City Council, Merseyside Police and Merseyside Fire & Rescue Service in the crackdown.

If you are caught smoking illegal drugs like weed, your landlord will contact neighbours and housing officers and ultimately ask the courts for a conviction order.

Concerned neighbours are encouraged, if they wish to report it, to speak to a housing officer (if the property is council-owned), or the landlord directly (if it is a private house).
Common give-aways of cannabis abuse in properties are the pungent smell of the drug and loud uncontrolled antisocial behaviour with regular mood swings of users.

Correspondingly, under Section 8 of the Misuse of Drugs Act (1971) it is an offence to allow others to use your premises to smoke cannabis. So, even if you don’t use cannabis yourself, letting your friends or family use drugs in your house could see you evicted and/or facing criminal charges.
