40% of people make mistakes on their divorce papers

40% of people make mistakes on their divorce papers. Magnus Legal explains why you should get an expert involved from the beginning:

The first step people take when they wish to get divorced is the one people most commonly get wrong. The process begins with the divorce petition – often referred to as divorce papers – which must be served to your partner or spouse for the separation to begin. Completing this document is a legal requirement of all divorces, and failing to do so properly can mean it is returned to you.

According to Her Majesty’s Court and Tribunals Service, legal advisors send divorce papers back to the petitioner in approximately 40% of all cases. This is one of the many reasons why divorces should be handled by solicitors like the team at Magnus Legal. Even what should be a simple practice like serving divorce papers can be complicated and it is best to have a professional solicitor on your side who understands the complex process.

If you nevertheless wish to handle this early stage of the divorce process by yourself, only getting solicitors involved at a later stage when it gets even more demanding, there are some things you must know about divorce petitions. One of them is, of course, the cost. It might not sound like something that necessitates a fee, but there is a £550 charge required to start the divorce process. It must be paid before the petition is distributed. Failure to do so is one of the ten most common reasons divorce papers are rejected.

There are numerous other reasons a divorce petition may not be accepted. These can be simple things like ensuring the name, place and date of the marriage is identical to that on your certificate, or failing to include an address where the papers are to be served. However, many of them can be complicated and require you to understand the intricacies of divorce law.

For instance, there has to be a sufficient case for divorce made in the statement, rooted in one of the grounds for divorce as defined by law. You may, furthermore, have to include a certificate of reconciliation under certain circumstances, as well as details of any related proceedings that might impact the case.

If this all sounds a little daunting, that is understandable. Divorce law is a thorny procedure and can be baffling for ordinary couples to understand. If you need a friendly solicitor to guide you through the process and explain every step in simple, straight-forward language contact Magnus Legal for help.
